Nintendo definitely wax and wane as far as their terrible conduct is concerned. I think they are at their best when they are on the back foot and looking to prove themselves. When their consoles and games aren't selling as well as they hoped and they really have to work to gain consumer confidence.
When they have a big success, like the Wii or the Switch, they get lazy, clumsy and greedy.
One of their practices most detrimental to the gaming industry is their litigious nature. Cease and desist letters for non-profit fan projects, usually just after all the hard work has been done and the project is due to be published. Taking down hacking and modding projects, even those that do not open the door to running copied games and make use of legally purchased hardware and software.
And most recently their patent lawsuit with Palworld. However you feel about it, post-hoc filing patents and then suing another developer for breaking them is not only absurd but downright scummy. Regardless of its effect on Palworld, smaller developers are going to be terrified to explore certain genres for fear that Nintendo will retroactively declare themselves its creator and owner and legally bully them out of business with an army of lawyers. Innocent or not, indie devs cannot afford to defend themselves.
Creative and interesting new potential games will not exist because their creators experienced a chilling effect and it made them feel like they shouldn't bother. A real loss to the gaming industry.
Then there is the usual anti-consumer BS that has piled on over the years. Ballooning hardware and software prices, region locking, day one DLC, game key-cards, shut down servers, subscription services for online play (and subscriptions on top of that, like Pokémon Home or Switch 2 voice chat), the JoyCon drift and other faulty hardware scandals...
Need I go on.
Not to say that other console manufacturers and platforms are immune to criticism either. They are not. They suck too.
But Nintendo bank on this angelic image many people still hold for them, just because they made your favourite games from your childhood.
Corporations can do good things. They may employ good people. But they are not your friends. Give them your loyalty only if they earn it, and always be prepared to withdraw it if they should let down their side of the bargain. They are not entitled to your money.
