Charizard EX Explosive Vortex Bug

Hi I've just lost to someone who used Explosive Vortex on their charizard EX with just 2 fire basic energy attached... I was supposed to win but this attack caught me by surprise. How was this allowed? Don't you need to have 4 energy to even use it?
